Federal Judge Rules Obama Care Unconstitutional in its Entirety

Monday, January 31st, 2011

A federal district court judge in Florida (in a 26-state lawsuit) ruled Obama Care unconstitutional IN ITS ENTIRETY.  The scoreboard now stands at 2-2: two federal district courts (in Michigan and Virginia) have found the law constitutional; two others (another court in Virginia and now Florida) have found it unconstitutional.  What makes this Florida decision unique is that the previous three merely struck down the individual mandate.  This decision strikes the whole thing down because it held that the mandate is not severable from the rest of the law.

It’s important to note that these decisions are really meaningless because the U.S. Supreme Court will eventually address Obama Care and whether it is unconstitutional.  The Fourth Circuit is set to hear the appeal of the conflicting Virginia district court decisions in May, and, in the Florida case, the government will almost certainly appeal.
